Minnesota is a no-fault state: after a crash, your own auto policy's personal injury protection (PIP) pays certain medical and economic losses regardless of fault. State law requires at least $40,000 of PIP per person ($20,000 medical, $20,000 non-medical), liability of $30,000/$60,000/$10,000, and uninsured and underinsured motorist coverage of $25,000/$50,000 each. These are minimums, not recommendations.

What Minnesota requires

Figures as stated in Minnesota Statutes chapter 65B on the as-of date of this guide:

  • Basic economic loss benefits (PIP): a minimum of $40,000 per person, made up of $20,000 for medical expense and $20,000 for income loss, replacement services and related losses (Minn. Stat. 65B.44, subd. 1).
  • Residual liability: at least $30,000 for bodily injury to one person, $60,000 for injury to two or more people in one accident, and $10,000 for property damage (Minn. Stat. 65B.49, subd. 3).
  • Uninsured and underinsured motorist: separate coverages of at least $25,000 per person and $50,000 per accident each (Minn. Stat. 65B.49, subd. 3a).

Minimums are not recommendations

The right limits depend on what you own and what you could lose in a lawsuit. Minnesota law also sets thresholds for when an injured person can bring a claim against the at-fault driver; read Minn. Stat. 65B.51 or ask us to walk through it with you.

Questions for your review

  • Are your liability limits above the minimums, and do they match your assets?
  • Would a personal umbrella policy make sense for you?
  • Do your uninsured and underinsured motorist limits mirror your liability limits?
  • Which optional coverages are on your policy, and which were offered but not added?
